Perch Insights Privacy Policy

Scope of Privacy Policy

Perch Insights, Inc. (“Perch”) empowers customer experience (CX) leaders with data-driven insights to work proactively, leading to progressively better business decisions to expand customer lifetime value and minimize customer acquisition and service costs through the use of its proprietary platform (“Perch Insights Platform”). The Perch Insights Platform is provided on a business to business (B2B) basis and not on a business to consumer (B2C) basis, and is primarily designed to provide our B2B clients (“Clients”) with information as to the manner in which we manage the personal information of our Client’s end users or customers. 

This Policy complements and is in addition to related provisions of Perch’s Terms of Use (“TOU”), which may be found here.

As Perch’s Client base does business globally, this Privacy Policy is designed to be compliant with the applicable countries where Perch does, or contemplates that it may be doing business (including, for example, the European Union’s General Data Protection Regulation, known as “GDPR”).

Perch may update this Privacy Policy from time to time in response to changing legal, technical and business developments. We will take appropriate measures to notify you about material changes in a manner that is consistent with the significance of the changes we make. However, it is your responsibility to review the most current version.

 

Information About Our Clients’ Users

Please note that this Privacy Policy applies to Perch’s Clients who use the Perch Insights Platform as a SaaS product or who receive Perch’s ancillary professional services as part of the SaaS (“Services”). The Services may be used by Perch’s Clients to collect personal information about their end users, such as their name, phone number, or billing information. If you are an end-user who believes that one of Perch’s Clients has collected personal information about you through its use of the Perch Services, and you wish to withdraw consent, access your personal information, request correction or deletion, complain about the collection of your personal information, or exercise any other rights that you may have regarding your personal information, your query should be directed to that Client.

In some instances, we may handle information relating to our Clients’ own customers or end users as a service provider on behalf of our Clients. Our use of such information is governed by our agreements with our Clients. In addition, such information may be subject to our Clients’ own privacy policies. This Privacy Policy does not apply to such information.

Protecting your private information is our priority. This Statement of Privacy applies to Perch Insights Platform, and Perch Insights, Inc. and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Perch Insights, Inc. include www.perchinsights.com and Perch. The Perch application is a Business Intelligence and Analytics application. By using the Perch application, Perch’s Clients consent to the data practices described in this Privacy Policy. 

 

Collection of Our Client’s End Users’ Personal Information

In order to better provide our Clients with the Perch Services, Perch may collect personally identifiable information, such as: 

  • First and Last Name 
  • Mailing Address or Geographic Location 
  • E-mail Address 
  • Phone Number
  • User info for Client Chat tools such as Slack or MS Teams
  • Employer Name 
  • Role at Employer
 

We do not collect any personal information about any end users unless end users voluntarily provide that information to our Clients as part of the Services. However, you may be required to provide certain personal information to us when you elect to use certain products or services for our Clients. Again, this arrangement is between you and the Client. We will not use your personal information except to provide the Services to our Clients. 

Use of your Personal Information

Perch collects and uses your personal information to operate and deliver Services to its Clients. 

If you work for one of our Clients and you access the Perch Insights Platform or otherwise engage with Perch on behalf of one of our Clients, then the following may apply to you:


If you fill out a form, request information from us or create an account on our Service we will collect personal data from you such as your name, email address, phone number and your employer. In addition to the information you provide, when you use the Services, we may also collect information through cookies, web beacons, tracking pixels, and other automatic data gathering tools (“Data Tools”). These tools collect certain standard information that your browser sends to the Services such as your browser type and language, access times, and the address of the website from which you arrived at our website(s). They may also collect information about your Internet Protocol (IP) address, clickstream behavior (e.g., the pages you view, the links you click, and other actions you take in connection with the Services) and product information. We may also use some of these Data Tools in emails we send, and therefore may collect information using these tools when you open the email or click on a link contained in the email. We may combine information that we have collected offline with information we collect online (e.g., across other third party sites or hardware devices). We may also combine information we get from a third party with information we already have.


You can instruct your browser to refuse all cookies, as well as to indicate when a cookie is being sent. Please note, however, if you do not accept cookies, you may not be able to use some portions of the Services.


Security and Retention of Personal Data

We follow generally accepted industry standards to protect personal data from unauthorized access, destruction, use, modification, or disclosure, both during transmission and after we receive it. The security of our Client data is important to us, but note that no method of transmission over the internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect our Clients’ customers’ personal data, we cannot, nor do we, guarantee its absolute security. If we learn of a security systems breach, we will inform our Client and the authorities of the occurrence of the breach in accordance with applicable law.

We will retain your personal data for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Transfer of Personal Data

Your information, including personal data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction. Your personal data may be transferred to and maintained in such jurisdictions where the data protection laws may differ from those where you live.

If you are located outside the United States and choose to provide information to us or our Client(s), please note that we collect such data, including personal data, in the United States and process it there in addition to other jurisdictions. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to any such data collection.

Data Access Rights

Laws in the European Union, Brazil, certain U.S. states and other jurisdictions grant their residents rights regarding their personal data. Under those laws you may have rights to: (i) access, correct or rectify your personal data; (ii) obtain a copy of personal data we have stored; (iii) opt out of, restrict or object to processing of all or certain categories of personal data; and/or (iv) not to receive discriminatory treatment based on our processing of personal data or the fact that you have opted out of certain types of processing.


Sharing Information with Third Parties

Perch does not sell, rent or lease its Client lists or its customers’ end users/customer lists to third parties. 

Perch may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide Client support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Perch, and they are required to maintain the confidentiality of your information. 

Perch may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Perch or the site; (b) protect and defend the rights or property of Perch; and/or (c) act under exigent circumstances to protect the personal safety of users of Perch, or the public. 


Right to Deletion

You have rights to request deletion of your information. But if you can, please contact the Client directly if you have any questions or concerns about: 

  • Deleting your personal information from our records; and 
  • Directing any service providers to delete your personal information from their records.


Please note that we may not be able to comply with requests to delete your personal information if it is necessary to: 

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us; 
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; 
  • Debug to identify and repair errors that impair existing intended functionality; 
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law; 
  • Comply with the California Electronic Communications Privacy Act; 
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent; 
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; 
  • Comply with an existing legal obligation; or 
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.


Children Under Thirteen

Perch does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this application. 

External Data Storage Sites 

We may store your data on servers provided by third party hosting vendors with whom we have contracted. 


Changes to this Statement 

Perch reserves the right to change this Privacy Policy from time to time. We will notify our Clients about significant changes in the way we treat personal information by sending a notice to the primary email address specified in our Clients’ accounts, by placing a prominent notice on our application, and/or by updating any privacy information. Your continued use of the application and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
